XRACEAI – Terms of Use

These Terms apply to the XRACEAI website, applications, and related services (collectively referred to as the “Platform”) and govern the relationship between you, the user of the service, and XRACEAI Ltd, the owner and operator of the Platform. By creating an account or using XRACEAI, you agree to these Terms. If you do not agree with them, you should stop using the Platform immediately. XRACEAI is a software platform designed to help drivers and sim racers analyse performance data. Users may upload telemetry, lap data, or other performance-related files in order to generate visual analysis and AI-assisted insights.
1. Use of the platform
XRACEAI provides tools that allow users to upload telemetry and performance data, visualise driving behaviour, and receive automated insights generated through analytical models and artificial intelligence. The service is provided for informational purposes only. While XRACEAI aims to provide useful analysis, we cannot guarantee the accuracy, completeness, or usefulness of every output. Any insights generated by the platform should not be interpreted as professional advice or relied upon for competitive or commercial decisions without independent verification.
2. User Accounts
To use XRACEAI you may need to create an account and provide certain information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place under your account. You agree to provide accurate information when registering and to keep your account details up to date. XRACEAI may suspend or terminate accounts that violate these Terms or misuse the platform.
3. Telemetry & User Data
XRACEAI allows users to upload telemetry files, lap data, replay information, and other performance-related content in order to analyse driving behaviour and generate insights through the platform. You retain ownership of the data that you upload. However, by submitting content to XRACEAI you grant XRACEAI Ltd a non-exclusive, worldwide licence to host, store, process, analyse, and display that data as necessary to operate the platform and provide its services. You represent and warrant that you have the legal right to upload and process any telemetry or performance data submitted to the platform, and that doing so does not infringe the rights of any third party or violate any applicable law or agreement. XRACEAI does not independently verify ownership of uploaded content and is not responsible for user-submitted data. XRACEAI reserves the right to remove or disable access to any content that reasonably appears to violate these Terms or applicable law.
4. Third-Party Data Rights
Some telemetry or performance data may be subject to ownership, confidentiality, or contractual restrictions imposed by racing teams, leagues, game publishers, or other organisations. By uploading such data, you confirm that you have the legal right and necessary permissions to use and submit that data to XRACEAI. XRACEAI does not claim ownership of user-uploaded telemetry and is not responsible for verifying the origin or ownership of such data.
If XRACEAI becomes aware that uploaded data may infringe third-party rights, XRACEAI reserves the right to remove or disable access to that content.
5. AI-Generated Insights
XRACEAI uses analytical models and artificial intelligence to generate insights from telemetry data. In order to provide these features, uploaded telemetry or derived data may be processed using third-party AI infrastructure and cloud services. These providers act as technical infrastructure providers assisting the operation of the platform.AI-generated outputs are automated and may occasionally be incomplete or inaccurate.
6. Aggregated and Anonymised Data
XRACEAI may analyse aggregated or anonymised telemetry data to improve the platform, enhance analytical models, and develop new features.
Where data is used in this way, it will not identify individual users or disclose proprietary telemetry belonging to specific drivers or teams.
7. Acceptable use
Users must not use XRACEAI in any way that could harm the platform or other users. This includes uploading unlawful content, attempting to gain unauthorised access to systems, distributing malicious software, or interfering with the normal operation of the service.
Accounts that violate these rules may be suspended or terminated.
8. Intellectual Property
The XRACEAI platform, including its software, analytical models, visualisations, and underlying technology, remains the intellectual property of XRACEAI Ltd.
Users may access and use the platform for personal purposes but may not reproduce, distribute, reverse engineer, or commercially exploit the platform or its outputs without permission. Users may not extract, copy, or systematically reproduce analytical outputs from XRACEAI for the purpose of developing competing products or services.
9. Platform availability
XRACEAI aims to maintain a reliable service but cannot guarantee uninterrupted access. From time to time we may update, modify, suspend, or discontinue parts of the platform. XRACEAI may introduce new features, modify existing functionality, or discontinue certain services as the platform evolves.
10. Limitation of Liability
To the maximum extent permitted by law, XRACEAI Ltd is not liable for losses resulting from the use of the platform, including loss of data, business interruption, financial losses, or racing performance outcomes. Nothing in these terms limits liability where such limitation would be unlawful.
11. No Warranty
The XRACEAI platform is provided “as is” and “as available”. XRACEAI makes no warranties regarding availability, reliability, or accuracy of the service beyond what is required by law.
12. Payment & Subscriptions
Some features of XRACEAI may be offered through paid subscriptions or premium services. By purchasing a subscription, you agree to pay the applicable fees associated with the selected plan. Subscription tiers, pricing, and available features may change from time to time as the platform evolves. Where possible, XRACEAI will provide notice of significant changes before they take effect. Subscriptions may renew automatically at the end of each billing period unless cancelled in advance through your account settings or the payment provider used to complete the purchase. If payment cannot be processed or is not received, XRACEAI may suspend access to paid features until payment is resolved. Continued non-payment may result in cancellation of the subscription. Because XRACEAI provides digital services, refunds are generally not available once access to the service has been granted, except where required by applicable consumer protection laws. XRACEAI may offer promotional discounts or trial periods from time to time. Abuse of promotional offers, including the creation of multiple accounts to access repeated trials or discounts, may result in suspension or termination of accounts. If you believe a billing error has occurred, you agree to contact XRACEAI so the issue can be reviewed before initiating a payment dispute with your bank or payment provider.
13. Termination
You may stop using the XRACEAI platform at any time.
XRACEAI reserves the right to suspend or terminate access to the service if these Terms are violated, if the platform is misused, or where suspension is required due to legal obligations or significant changes to the platform.
If access to the service is terminated, you must stop using the XRACEAI platform and any related content, systems, or services made available through it.
14. Changes to These Terms
XRACEAI may update these Terms from time to time to reflect changes to the platform, updates to our policies, or new legal requirements.
When this happens, the updated version will be published on the XRACEAI website with a revised “Last updated” date. Continued use of the platform after such updates indicates acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising in connection with the XRACEAI platform will be subject to the jurisdiction of the courts of England and Wales.
