XRACEAI – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of XRACEAI’s website, software, AI tools, analytics services, and any XRACEAI GPTs or assistants (collectively, the “Services”).
By accessing or using XRACEAI, you agree to these Terms.

If you do not agree, you should not use the Services.

1. Use of the Services

You may use XRACEAI for personal or professional purposes related to motorsport, sim racing, analysis, or performance improvement.
You agree not to:

  • Use the Services for illegal activities

  • Reverse engineer, copy, or misuse XRACEAI systems

  • Upload harmful, misleading, or infringing content

  • Attempt to disrupt or overload XRACEAI infrastructure

  • Violate the terms of any motorsport game or platform from which you upload/stream telemetry

XRACEAI reserves the right to suspend or terminate access for any misuse.

 


2. User Accounts

Some features may require creating an account.

  • You are responsible for:

  • Keeping your login credentials secure

  • Ensuring the information you provide is accurate

  • Any actions taken under your account

XRACEAI is not liable for unauthorized use of your account.

3. Telemetry & User Data

If you upload or stream telemetry data (e.g., speed, RPM, GPS, session data):

  • You retain full ownership of your data

  • You grant XRACEAI permission to process it for analysis and insights

  • You confirm you are allowed to upload the data under the rules of the relevant game, platform, or competition

XRACEAI may use anonymized, aggregated data to improve the platform.

We never sell your data.

 


4. AI-Generated Insights

XRACEAI provides AI-powered analysis and coaching insights.

These outputs are:

  • Suggestions, not guaranteed results

  • Based on available data and may contain inaccuracies

  • Not a substitute for professional driver coaching or engineering advice

  • You agree to use AI outputs responsibly and at your own risk.

  • XRACEAI is not responsible for decisions or actions taken based on AI suggestions.

5. Intellectual Property

All XRACEAI branding, interfaces, designs, models, AI prompts, tools, and software are protected intellectual property.

You may not:

  • Copy, distribute, or modify XRACEAI content

  • Reproduce platform assets

  • Claim ownership of XRACEAI insights, models, or designs

  • Use XRACEAI trademarks without permission

Telemetry data you upload remains yours.
Analysis and derived insights generated by XRACEAI remain part of the XRACEAI system.

6. Third-Party Integrations

XRACEAI may integrate with:

  • Motorsport games

  • Sim racing platforms

  • External APIs or hardware

We are not responsible for changes made by third parties, nor for downtime caused by dependencies.

Always follow the terms of the original game or hardware provider.

 


7. Payment & Subscriptions

(If applicable)

  • Prices, subscription tiers, and features are subject to change

  • Refunds are handled in accordance with local laws

  • Abuse of promotional offers may result in account suspension

  • Non-payment may lead to loss of access to paid features

A detailed subscription policy will accompany future releases.

8. Limitation of Liability

To the maximum extent permitted by law:

XRACEAI is not liable for any losses, injuries, or damages arising from use of the Services

This includes, but is not limited to:

  • Data loss

  • Incorrect AI recommendations

  • Hardware issues

  • Real-world driving incidents

  • Financial decisions

  • Integration or connectivity failures

You use XRACEAI entirely at your own risk.

 


9. Availability of Services

XRACEAI aims for high availability but does not guarantee:

  • Uninterrupted access

  • Error-free performance

  • Preservation of historical data

Features may change or be discontinued without notice.

You may stop using the Services at any time.
XRACEAI may suspend or terminate access if:

  • You violate these Terms

  • You misuse the platform

  • Required by law or platform changes

Upon termination, you must stop using XRACEAI content and systems.
